2/14/2011 Speeding ticket attorney : “driving to fast for conditions” legal blog post

Why was I was issued a Washington speeding ticket for going "too fast for conditions". 

What exactly does this mean?  Will this go on my dmv record? Will this increase my insurance rates?

What does the city have to prove? 

How can I refute this fact, especially if I wasn't even speeding?

“Too fast for conditions” means you were traveling at a speed faster than what was prudent for the conditions at that time.  See RCW 46.61.400(1).  The conditions can include but are not limited to traffic, weather, construction, and pedestrians. 

This does not mean you were traveling above the speed limit.  For example, while the speed limit may be 60 mph when traveling south bound on I-5 approaching the ship canal bridge in Seattle, the reality is most of the time you will be in slow moving traffic.  Trying to go 50 mph in those traffic conditions despite being under the limit would not be prudent and safe.  The same can be said when there is snow on the road.  Obviously, you want to travel at a speed lower than the normal speed limit in order to avoid sliding and crashing.

2/2/2011 Traffic ticket attorney : Driving on a suspended license posting

Washington State’s traffic laws and driving with a suspended license in a vehicle that is registered in your name.

Why should you never drive a vehicle registered to you if your license is suspended? 

First of all, if you have a suspended license, I recommend you do not drive at all.  Follow the law.  However, if you choose to ignore my first piece of advice, then please at least do not drive your own vehicle. 

Police Officers all day long run license plate checks.   They will run your license plate and if it comes back as registered to a suspended driver, they will pull over the car.  They do not have to see the car do any illegal movement to be pulled over for the suspended license.  Technically, the Officers should first check to see if the driver matches the description of the registered suspended driver.  However, reality is the Officers will simply pull you over.  I have had many female clients pulled over because they were driving the car registered to suspended husbands. 

So be very careful whenever driving a car registered to someone with a suspended license.  If you do get pulled over and receive a traffic ticket for a moving violation or driving on a suspended license then immediately contact out office by filling out this form.  Driving on a suspended license can become a very big problem and will stay on your dmv record for a long time.

How exactly is a Washington traffic ticket "properly issued" pursuant to Washington State’s traffic laws

What happens if a Washington ticket is not "properly issued"?

It is important to pay attention to what type of officer stops you, where they stop you, and which court you are supposed to respond to. As noted in a previous blog entry, these three things must match. 

In the old days, an Officer from outside of a jurisdiction did not have the authority to stop and issue tickets.  However, most cities and counties now have mutual aid agreements which permit Officers to work across city and county lines.  It is always good to double check the mutual aid agreement though.

An officer from another jurisdiction will occasionally stop and issue tickets.  For example, a City of Seattle Officer will be driving home in Issaquah on their SPD motorcycle and witness an illegal driving movement.  They will stop the individual and issue a ticket.  That ticket will either have to be filed in the Issaquah Municipal Court or the King County District Court.  The Seattle Officer cannot file the ticket with the Seattle Municipal Court because they do not have jurisdiction over Issaquah matters.

Bottom line – make sure you read the bottom of the ticket you receive to see where you are supposed to respond to and pay attention to who pulled you over and where it occurred.  A traffic ticket for an illegal action in Snohomish County cannot be heard in a King County Court. 

If your ticket is being heard in the wrong court, speak up because the Judge should dismiss the case.  Just be warned, it is possible for the ticket to be re-filed in the proper court afterwards.

What exactly is a "gore point" violation for purposes of a Washington traffic ticket?

There is no actual Revised Code of Washington definition for a "gore point." It is my understanding that a "gore point" is where two lanes merge together, typically on a freeway on/off ramp.  The "gore" is triangle painted in white with a solid white tail.  Officers believe it is illegal to cross both the triangle as well as the solid white tale. 

I completely agree that it is rude driving to cut across these points when it is done in a manner to cut in front of other drivers who are patiently waiting their turn to merge. 

However, I also do not think the movement is entirely illegal.  Unless the triangle is painted in yellow (see RCW 46.61.150), then I do not think it is illegal unless it is done in conjunction with another illegal action.  Examples include a sign being posted at the scene prohibiting the movement; the lane change was done in an unsafe manner, or without a signal. What exactly is a "Pace" as it relates to Washington traffic tickets or Seattle speeding tickets? This is an example of why you need to hire an experienced Seattle traffic ticket attorney to fight your ticket…Pacing can be a tough thing to measure.

A pace is when the Officer determines your speed by driving his car at comparable speeds. In an ideal situation, an Officer will pull up behind your vehicle and then follow it for a sufficient length of time while making sure the distance between the two cars remains the same. The Officer then can look at his speedometer and determine the other vehicles speed by matching.

Under Spokane v. Knight, 96 Wash, 403, 165 Pac. 105 (1917), the Court describes how speedometers are mechanical devices that must be checked regularly in order to establish they continue to measure speed accurately.

There are many potential problems with obtaining an accurate reading from a pace. They include not having an accurate speedometer and not maintaining a constant distance between the two cars. Additionally, the Officer may attempt to "pace" a vehicle from a different lane. This can also be problematic if done on a curve because the distance traveled on the inside portion of the curve will be shorter than the outside – thus giving the illusion that the inside vehicle is traveling faster.

The classic excuse I hear from people in court for speeding is "I was going with the flow of traffic." Sorry, but for Seattle speeding tickets that doesn’t matter. Everyone was speeding so everyone was breaking the law. "Why was I the only one pulled over?" Maybe you had a brightly colored car, maybe you were in the lane most accessible to the officer, or it could be as simple as (bad) luck of the draw.

October 15, 2010 Traffic Infraction Deferrals - what are they?

In Washington State, each person is allowed two deferrals every 7 years. One deferral for a moving violation and one for a non-moving violation. See RCW 46.63.070. Whether you are given a deferral or not depends on a variety of other factors as well. You are not allowed to have a deferral if you have a commercial driver's license per State statute.

Whether you are granted a deferral is also up to the Judge's discretion. Some Judges will not permit you to do deferrals on Speeding in School Zone tickets or if you did not have insurance at the time. Some Courts, like the Cascade District Court in Snohomish County, as a policy will not allow you to have a deferral no matter what.

The conditions of a deferral also vary depending on the Court and Judge. The typical deferral will be a 1 year probationary period where you need to avoid getting a ticket. Some Courts close the probation period as soon as you pay the court costs. Some even require you to take a driving class.

The key condition that every person must be especially careful about is what type of new traffic infraction would be considered a violation. Some deferral's clearly state only a new moving violation would be considered a violation of the deferral policy. Other deferral agreements rightfully or wrongfully seem to indicate a moving or non-moving violation can be considered a violation. There are also the rare courts that consider even receiving a new ticket, as opposed to the actual committed finding, a violation.

So a word of caution � don't automatically think you will get a deferral when walking into court and make sure you read what you are agreeing to.

9/2/2010 Seattle speeding tickets –fight your speeding ticket! Hidden speed limit sign? This is a classic excuse I hear. Pretty much the only time when this could possibly work is if the speed limit reduces and the new speed limit sign was block so you continue to travel under the speed limit of the old sign but not the new sign. The typical example is a school zone. The typical speed is 30 mph on arterial streets but will drop to 20 mph in a school zone. You would have to show the posting of the school zone speed limit was obscured and also show you were traveling below the regular speed limit. The best way to show this is by taking photographs of the scene. Your argument also won’t hold a lot of water if you are claiming you couldn’t see the school zone sign but you were also going over the regular speed limit as well. Defendant: "Your Honor, the sign telling me the speed limit was 20 mph was blocked!" Judge: "OK, so if it wasn’t a school zone then the normal speed limit would have been 30 mph…. but you were traveling at 35 mph so you were going 5 mph over the limit which is illegal as well….". Prior to June 30th, the Model Traffic Ordinance was not properly updated to authorize city police officers to enforce a couple of traffic laws – the most notable being the cell phone and texting law. 7/18/2010 Seattle traffic tickets have been on the rise. The police are going after speeders and Seattle traffic ticket offenders. Our Seattle traffic ticket law firm specializes in fighting tickets. I have been seeing a lot more "failure to yield to emergency vehicle" tickets recently. The fine for this ticket is over $1000! Being cynical, I strongly suspect officers have been instructed to keep a closer eye for these types of tickets to get the additional revenue. Under RCW 46.61.210, when an emergency vehicle with its lights and siren is approaching you from behind, you must pull to the right. What officers have been doing is giving this ticket when they are pulling over the defendant and the defendant pulls over to the left hand shoulder. I see cops pulling people over every day on the left hand side (they will instruct you to pull over to the left too if you try to go to the right.) It seems reasonable to pull to the left if there is a large shoulder there and you were originally traveling in the left hand lane but don\’t do it unless specifically instructed to by the officer!
