Washington State’s traffic laws, how do I know which lanes in the state are open for legal driving while hauling a trailer? If you receive a moving violation in the left lane while hauling something you might have a good defense?

Many people do not realize it is illegal to tow something in the far left lane.  Whether you are towing another car, jet ski, or a little u-haul container, it is illegal to drive in the far left lane when on the free way. 

RCW 46.61.100(3) states:

No vehicle towing a trailer or no vehicle or combination over ten thousand pounds may be driven in the left-hand lane of a limited access roadway having three or more lanes for traffic moving in one direction except when preparing for a left turn at an intersection, exit, or into a private road or driveway when a left turn is legally permitted…

For purposes of Washington State’s traffic laws, how do I know which carpool lanes in the state are open during off hours and which ones are carpool all the time.   If you receive a moving violation in the HOV lane then you know what I mean when you see the price of this traffic ticket.

Some carpool (HOV) lanes are open to all traffic at certain times, some are permanently HOV, and some permit you to pay a fee to drive there even if you do not have sufficient passengers. 

As with all driving, the key is to pay attention and read the signs that are posted.  For example, there are places on State Highway 520 where the HOV lane is only for 2 or more people but the lane is open to all traffic during the night.  Another portion of WB 520 near the floating bridge requires vehicles to have 3 people to use the HOV lane.  On State Highway 167 in Kent, a driver can purchase a special electronic pass that permits him or her to drive in the HOV lane without passengers for a fee.

What if the license plate is in the car window?

In Washington State, a car must have a license plate on the front and back.  See RCW 46.16.240.  These license plates must be hung in a manner so they can be plainly seen and read at all times.  This means putting a tinted lens over the license is probably illegal.  Placing the license plate inside the window of your vehicle could also potentially be interpreted as not being plainly seen at all times. 

If the front of your car is constructed in a manner, which prevents the ability to hang a front license plate, you will need to get permission from the Washington State Patrol for that deviation from the law. Get the permission before you are pulled over not afterwards.  You will want to keep proof of the permission with your car.  Just be prepared to be pulled over anyways…

1/04/2011 - Tacoma Traffic Ticket Attorney | Improper jurisdiction for Traffic Tickets

This post discusses why you need to hire an experienced Tacoma speeding ticket lawyer to fix your speeding ticket…Pacing can be a tough thing to measure. What exactly is a "Pace" as it relates to Speeding tickets or Tacoma traffic tickets?

Pacing is when the Officer determines your speed by driving his car at comparable speeds. In this predicament, an Officer will pull up behind your vehicle and then follow it for a sufficient length of time while making sure the distance between the two cars remains the same. The Police Officer then can look at his speedometer and determine the other vehicles speed by matching.

Traffic law : Spokane v. Knight, 96 Wash, 403, 165 Pac. 105 (1917), the Court describes how speedometers are mechanical devices that must be checked regularly in order to establish they continue to measure speed accurately.

There can be problems with obtaining an accurate reading from a pace. Some include not having an accurate speedometer and not maintaining a constant distance between the two cars. Moreover, the Officer may attempt to "pace" a vehicle from a different lane. This can also be problematic if done on a curve because the distance traveled on the inside portion of the curve will be shorter than the outside – thus giving the illusion that the inside vehicle is traveling faster.

10/10/2010 Deferrals for traffic ticket violation in Tacoma, Wa

The conditions of a traffic ticket deferral also vary depending on the Court and Judge. The typical traffic violation deferral will be a one year probationary period where you need to avoid getting a ticket. Some Courts close the probation period as soon as you pay the court costs. Some even require you to take a driving class.

The key condition that every person must be especially careful about is what type of new traffic ticket infraction would be considered a traffic violation. Some deferral's clearly state only the new moving violation would be considered a violation of the deferral policy. Other deferral agreements rightfully or wrongfully seem to indicate a moving or non-moving violation can be considered a traffic violation. There are also the rare courts that consider even receiving a new ticket, as opposed to the actual committed finding, a traffic violation.

See RCW 46.63.070 In Washington State, each person is allowed 2 deferrals every seven years. One deferral for a moving violation and one for a non-moving violation. . Whether you are given a deferral or not depends on a variety of other factors as well. You are not allowed to have a deferral if you have a commercial driver's license per State statute.

Whether you are granted a deferral is also up to the Judge's discretion. Some Judges will not permit you to do deferrals on Speeding in School Zone tickets or if you did not have insurance at the time. Some Courts, like the Cascade District Court in Snohomish County, as a policy will not allow you to have a deferral no matter what.

9/2/2010 Tacoma traffic tickets can be a problem for drivers. As I have mentioned before, if you are under 18 years old, you need to be very careful about getting tickets. Intermediary license holders will have their license suspended for 6 months if they receive two tickets. See RCW 46.20.267. The one piece of good news is regarding intermediary licenses – a single ticket for one or more traffic offenses constitutes a single traffic offense. My one concern is when an officer stops an individual with an intermediary license and then writes two infractions on separate tickets even though it comes from the same incident. Be very careful if this happens because you could end up getting a six month suspension after your first and only stop! You should hire a local traffic attorney who knows the various Tacoma courts.
